Duty to Defend

An obligation to provide or pay for a legal defense in response to a claim. It may arise from contract wording, insurance policy terms, or law, with different triggers and procedures. A duty to defend is not always the same as a duty to reimburse losses after responsibility is determined.

Why it matters for owners

Defense obligations can create immediate costs and should be reviewed alongside indemnity and insurance provisions.
